1. Before you register

This document sets out what Aerial commits to, what we ask of you, and exactly who is responsible for your child at each moment. We have written it in plain language and explained the reason behind each rule.

Two sections matter most:

  • Section 6 — Responsibility map. Who is responsible, when, and for what. Read this first.

  • Section 17 — Risks and liability. Gymnastics involves height, rotation and apparatus. We

reduce risk as far as it can be reduced (Section 7 sets out how), but it cannot be removed.

If you do not agree with any part of this document, please do not register.

2. Who this agreement is between, and words we use

2.1 This agreement is between AERIAL SPORTS CLUBS AND FACILITIES MANAGEMENT AND OPERATION – L.L.C., license CN-5424426, trading as Aerial Gymnastics Academy ("Aerial", "the Academy", "we", "us"), and the parent or legal guardian registering a child, or the adult aged 18 or over registering themselves ("you").

2.2 "Participant" means the child or adult attending Aerial programmes.

2.3 Registration must be completed and accepted by the parent or legal guardian. Another person may enter the information, but acceptance of these Terms must be given from the parent's or guardian's own email address or mobile number, which our system records.

2.4 Season and academic year. Aerial runs six seasons per year. The academic year is the twelve-month period made up of those six consecutive seasons, as published in the Aerial schedule. Where these Terms refer to a season, they mean the season stated on your invoice.

3. How you accept these terms

3.1 You accept these Terms by ticking the acceptance box on the registration form at https://reg-form.aerial-gymnastics.com, or by signing a printed copy at one of our locations.

3.2 Acceptance given electronically is legally binding and has the same effect as a handwritten signature, under UAE Federal Decree-Law No. 46 of 2021 concerning Electronic Transactions and Trust Services.

3.3 Our system records the name of the person accepting, the date and time, and the version number of these Terms. A copy of the version accepted is sent to the email address provided.

3.4 No attendance without registration. Our booking system does not permit attendance at any session — including a first, trial or assessment session — without a completed registration. Every Participant entering a training area has therefore accepted these Terms.

3.5 These Terms remain in force for as long as the Participant is enrolled, across all seasons, packages, camps and events, until we issue a new version under clause 21.2.

3.6 Where you register more than one child, these Terms apply separately to each.

4. What this agreement covers

4.1 Programmes. Season classes, trials and assessments, private and semi-private sessions, open gym, adult classes, holiday and seasonal camps, birthday parties and private events, workshops and masterclasses, in-house displays and competitions, and any external competition, trip or travel programme Aerial organises or facilitates.

4.2 Locations. Aerial operates from venues chosen for accessibility — shopping malls, schools and educational institutions, sports facilities and clubs, hotels and resorts, and community centres — whether owned, leased, hosted, hired or otherwise made available to Aerial. These Terms apply at every such venue, current or future, and at any external venue used for an Aerial activity.

4.3 These Terms apply to the Participant and, where stated, to everyone accompanying the Participant to an Aerial venue.

5. Registration and access

5.1 When enrollment is complete. When the registration form has been submitted in full; these Terms accepted; medical and emergency contact information provided; the invoice paid in full; and written confirmation received from the administration.

5.2 Confirmation is always in writing. A place is reserved only by written confirmation from the administration. Please do not rely on a verbal indication from a coach or reception.

5.3 Age. Aerial accepts Participants from 2 years of age. Participants under 4 are accompanied in the training area by a parent or guardian where the programme requires it.

5.4 Trials and assessments. A trial or assessment is booked through the registration form and is charged at the rate published in the current Aerial price list at the time of booking. Assessments take approximately 10–15 minutes for children and 30–60 minutes for adults. The outcome determines the level at which the Participant enrolls.

5.5 Places. Places are limited and allocated first come, first served.

5.6 Right to refuse. Aerial may decline an enrollment or entry to its premises. Where we decline before any session has been attended, everything paid for that enrollment is refunded in full, including the registration fee.

5.7 Placement. Aerial decides the level and group in which a Participant trains, based on the coaching team's technical assessment. Groups matched in ability are both safer and better for progress.

5.8 Keeping information current. Please tell us promptly, in writing, of any change to medical information, contact details, emergency contacts, or who is authorised to collect the Participant. We act on the information we hold.

6. Responsibility map — who is responsible, when, and for what

This section governs. Where any other clause appears to say something different about supervision, this section prevails.

6.2 Aerial's supervision window is therefore from 10 minutes before the session starts until 10 minutes after it finishes, in the designated waiting area and the training area. Within that window your child is with our staff. Outside it, your child is with you.

6.3 What Aerial is responsible for

  • The condition and safety of the training area and apparatus during our sessions

  • The qualification, vetting and conduct of our coaching staff

  • Group sizes and the supervision ratio (clause 7.1)

  • Delivering the session as scheduled, or rescheduling it

  • Presence of a person able to administer first aid (clause 7.3)

  • Contacting you when your child cannot continue a session (clause 7.4)

  • Recording incidents and informing you (clause 7.5)

  • Holding the personal data you give us securely and lawfully (Section 20)

  • Holding public liability insurance (clause 7.8)

6.4 What you are responsible for

  • Disclosing the Participant's medical conditions, allergies, injuries and medication —

completely, and keeping it current (clause 12.2)

  • Holding valid health insurance cover for the Participant (clause 12.8)

  • Bringing the Participant on time, and collecting on time (Section 13)

  • Everything happening outside the supervision window in clause 6.2

  • The behavior of the Participant and of everyone who accompanies them (clause 14.2)

  • Not photographing or recording at Aerial venues (Section 16)

  • Payment through official channels (clause 8.7)

  • Keeping your contact details and authorized-collection list up to date

7. What Aerial commits to — and the limit of each commitment

7.1 Group sizes. Our policy is a maximum of 12 Participants per coach. In exceptional operational circumstances a group may reach 15. Limit: the ratio never exceeds 15. Where a coach is unavailable, groups are merged within that limit or the session is rescheduled.

7.2 Our coaching team. Every coach is selected and vetted before working with children. Our coaches hold qualifications ranging from formal education in sport and gymnastics through to certification recognised by a national gymnastics federation. Every member of staff working with children holds a valid UAE Good Conduct Certificate. Limit: no person works with children before those checks are complete.

7.3 First aid. At least one member of staff able to administer first aid is present in the gym during sessions. A first aid kit is maintained at every location. Limit: first aid is not medical treatment. Where more is required we follow our emergency protocol and call for medical assistance (clause 12.6).

7.4 If your child cannot continue a session. We contact you within 10 minutes. Limit: we use the contact details on file, which is why clause 5.8 matters.

7.5 Incidents. Any injury, including a minor one, is recorded in our incident log with the date, what happened and what was done. You are informed the same day; where an injury requires more than basic first aid, immediately. Limit: an incident record documents an event. It is not an admission of liability.

7.6 Equipment and mats. Mats and apparatus are checked on every training day. A designated head coach at each location is responsible for apparatus setup, mat placement and training- area safety. Apparatus is installed and maintained in accordance with the written instructions provided by the company that supplied and installed it. Equipment judged unsafe is taken out of use.

7.7 Medical information reaching the coach. Information you enter at registration is passed to the coaching team and is visible to the coach at the Participant's trial and assessment, and thereafter held with the group record. Limit: we can only pass on what you have told us.

7.8 Our insurance. Aerial holds a public liability insurance policy of AED 5,000,000 covering its activities. Limit: this does not replace the personal health cover required under clause 12.8.

7.9 Safeguarding. Coaches do not contact Participants privately or outside official Aerial channels. Physical contact during training is limited to spotting and technical support. Any safeguarding concern is treated as a priority and may be raised through clause 15.1.

7.10 Watching your child train. We hold one open training session per season at which parents may watch, and level assessments at which progress is reviewed.

7.11 Emergency procedures. In a government safety alert, civil defence warning or security advisory, we may evacuate, shelter in place or suspend activities. Everyone on site follows the instructions of our staff and of the authorities.

8. Fees, VAT and payment

8.1 Programmes are payable in full at registration. Aerial does not offer instalment plans.

8.2 VAT. Aerial is registered for VAT in the UAE. All advertised and invoiced prices include 5% UAE VAT. A tax invoice is issued for every payment.

8.3 Registration fee. AED 105 per Participant (AED 100 plus AED 5 VAT), charged once per Participant per academic year as defined in clause 2.4, not pro-rated for a Participant joining part-way through the academic year. Non-refundable once processed, except under clause

5.6 or where Aerial cancels a programe entirely before it begins.

8.4 Seasons and packages. Packages are sold by season or by month. A package purchased for a given season must be completed within that season, except where clause 9.2, 9.4 or 9.8 applies. The validity period is stated on your invoice.

8.5 Private sessions. From AED 250 including VAT, depending on coach and duration.

8.6 Sibling discount. 10% off the second child's package fee where more than one child from the same family is enrolled. Applies to package fees only — not the registration fee, camps, private sessions or events — and does not combine with other offers.

8.7 One price, any payment method. The same price applies whether you pay by cash, card, bank transfer or online. No surcharge is applied to card or online payments. Money handed directly to a coach is not accepted and does not settle your invoice — coaches are not authorized to take payment, and untraceable cash protects neither of us.

8.8 Price changes. Prices may be revised between seasons. A change never affects a package already paid for.

8.9 Non-payment. Access to classes may be paused until an unpaid invoice is settled. A pause for non-payment does not extend package validity or create make-up entitlements.

9. Refunds, credits and changes of circumstance

9.1 General position. Fees are non-refundable, except in the situations set out below. Our costs — venue rent, coach salaries, equipment — are committed for the season whether or not a place is used. The exceptions cover the situations that actually happen to families.

9.2 Medical. Where a Participant cannot continue for medical reasons and you provide a valid medical certificate from a licensed UAE medical practitioner, we issue either:

a credit for the unused sessions — the default remedy. By way of exception to clause 8.4, a medical credit may be carried into the season immediately following the season in which it was issued, and remains valid until the end of that following season. It is usable across any Aerial programme; or a pro-rata refund of the unused sessions, where the condition prevents a return within that period.

A short illness of a week or so is covered by the make-up allowance in Section 10 and does not require a certificate.

9.3 Relocation outside the UAE. On production of evidence — a cancelled residence visa or an employer letter — unused sessions are refunded pro-rata or converted to credit, at your choice. An administrative charge of up to 30% of the refunded amount is retained, and the registration fee is not refunded. Please give 14 days' notice where you can.

9.4 Freeze. You may freeze a package once per season for up to 4 weeks, on written notice. Package validity is extended by the freeze period. Please request in advance where possible; for a medical event, a request immediately afterwards with a certificate is accepted.

9.5 First two sessions. If, within the first two sessions of a Participant's first enrolment, you or the coaching team conclude the programme is not the right fit, the remaining sessions convert to credit. The registration fee is retained.

9.6 If Aerial cancels. Where Aerial cancels a programme entirely and does not offer a reasonable alternative, the full value of the cancelled sessions, and the registration fee where the programme had not begun, is credited or refunded at your choice.

9.7 How amounts are calculated. Except under clause 9.6, the refundable amount is the value of sessions remaining on the date we receive your request and supporting documents. Sessions already attended, and sessions missed before the request, are not included.

9.8 Circumstances beyond our control. Where classes cannot run because of government directives, civil defence or security instructions, venue closure, public health measures or severe weather, we reschedule the affected sessions or extend package validity by the equivalent period, so sessions are preserved rather than lost. No refund arises.

9.9 Expiry. Sessions unused at the end of the package validity period — as extended under clauses 9.4 and 9.8 — are forfeited, except under clauses 9.2, 9.3 and 9.5.

9.10 Transfers. Packages, sessions and credits are not transferable to another person. They may be transferred between siblings enrolled at Aerial with our written agreement.

9.11 Level and group changes. A change of level or group is made on request and is subject to assessment and availability.

  • Transfer within the same package tier — a group of the same session length and the same

frequency — is made at no additional charge.

  • Transfer to a higher tier — a longer session, greater frequency, or a higher-priced

programme — takes effect through an upgrade of the package, and the price difference is payable. No discount applies to the difference.

9.12 How to request. All requests go through our official request form (clause 15.1), with the Participant's name, invoice number, reason and supporting documents. Approved refunds are returned to the original payment method within 7–14 business days of approval.

10. Absence and make-up classes

10.1 Notification deadline. For a make-up class to be available, notice of absence must reach us in writing before 11:00 AM on the day of the class. The reason is practical: coaches, group sizes and apparatus rotations are set in the morning, and after 11:00 AM the session is already planned around your child.

10.2 Notice after 11:00 AM does not qualify for a make-up unless a medical certificate is provided. No make-up is available for an unnotified absence.

10.3 Allowances.

10.4 Validity. Make-ups are taken within the validity period of the package they relate to, subject to availability, and do not carry forward. Unused entitlements expire with the package and have no cash value.

10.5 Booking. Make-ups are booked in advance and confirmed in writing. A Participant arriving without a confirmed booking cannot be admitted — the receiving group is at capacity, and adding a child changes the ratio for everyone in it.

10.6 A make-up may be with a different coach, in a different group, or at a different Aerial location.

10.7 Extended absence. Tell us as soon as you can and provide a certificate; clause 9.2 or 9.4 then applies.

10.8 Private sessions. Cancelled or rescheduled with at least 12 hours' notice. Cancelled later, or not attended, the session is charged in full — the coach's time is reserved and cannot be reallocated.

10.9 Late arrival. Classes end at their scheduled time and coaches do not extend them, because the next group is waiting. A Participant more than 30 minutes late cannot join a regular class; more than 15 minutes late cannot join a trial or assessment. Joining after the warm-up has finished carries a real injury risk.

11. Schedule, venues and coaches

11.1 Class times are set by Aerial management and subject to availability.

11.2 Aerial may change season dates, class times, venues or the coach assigned to a group where operationally necessary, giving as much notice as circumstances allow.

11.3 Coach continuity. We aim to keep the same coach with a group throughout a season. Where a change is necessary we tell you in advance, and the incoming coach receives a handover covering each Participant's level, progress and medical information on file. A Participant is enrolled with the Academy rather than with an individual coach, and a change of coach is not itself a ground for a refund.

11.4 Public holidays. Aerial operates every day, including UAE public holidays. Where a specific closure is required — usually by a venue — it is published in the season schedule in advance, and no make-up or refund arises from a closure published in advance.

11.5 Renewal. When registration opens for a following season, a Participant's existing time slot is held for 7 days and secured by payment. After 7 days, unreserved slots are released.

12. Health and medical

12.1 Fitness. You confirm the Participant is physically able to take part in gymnastics training and that you know of no condition making participation unsafe for them or for others.

12.2 Disclosure — your responsibility. Please disclose, before training begins, any medical condition, allergy, injury, disability or medication that may affect participation or that our staff would need to know in an emergency, and tell us when something changes. Our coaches supervise on the basis of what you tell us.

12.3 Please do not bring a Participant who is unwell, injured, or has a contagious condition.

12.4 Medication. Any medication needed during a session is handed to a coach with written instructions. Coaches do not hold or administer medication otherwise.

12.5 We may ask for further information about fitness or eligibility before accepting or continuing an enrollment.

12.6 Emergency treatment. You authorize Aerial and its staff to give first aid and, where they judge it advisable, to call emergency services and arrange transport to a medical facility. We contact you as soon as we can, and within 10 minutes where the Participant cannot continue the session.

12.7 Medical costs. The cost of treatment or transport is yours, whether called by Aerial staff or by a third party.

12.8 Health insurance. Health insurance cover is mandatory for residents of the Emirate of Abu Dhabi under Abu Dhabi law. You confirm the Participant holds valid cover and will maintain it. We are not asking you to buy anything additional — we are confirming that the cover you are already required to hold is in place, because the cost of treatment falls to you under clause 12.7. Aerial does not provide health or accident insurance for Participants and may ask to see evidence of cover.

13. Arrival, collection and leaving the premises

13.1 The supervision window is set out in Section 6 and governs this Section.

13.2 Arrival. Please arrive 10 minutes before the session, changed and ready. Arriving earlier is fine, but the Participant remains with you until the supervision window opens.

13.3 Collection. Please collect the Participant at the scheduled finish time, and in any event within 10 minutes of it.

13.4 Authorized collection. We release a child to you, or to a person you have named in writing as authorised to collect. We may ask for identification. Where someone not on that list arrives, we contact you and do not release the child until you confirm.

13.5 Children are not released alone. A child Participant is not released to leave the venue unaccompanied, except under clause 13.6.

13.6 Independent arrival and departure. Where a Participant is 12 years of age or older, you may authorize independent arrival and departure. This requires a separate written authorisation, not a tick-box inside these Terms, stating the agreed method — on foot, by bicycle, by school transport, or with a named adult. Aerial's responsibility ends at the moment the Participant leaves the premises, and Aerial may decline the authorization where it considers it unsafe.

13.7 Classes held inside a school. Where a class runs at a school the Participant also attends, please ensure the Participant travels from their classroom to the training area. We do not collect Participants from elsewhere on a school site and are not responsible for them between the end of the school day and their arrival with us. The same applies after the session.

13.8 Third-party venues. Many of our activities take place at venues we do not own or control. We provide coaching and supervision during our own sessions and within our designated areas. We do not control the security, access, layout or maintenance of those venues, and everyone attending follows the venue's own rules.

13.9 Siblings and accompanying persons. They remain your responsibility at all times, stay in the designated waiting area, and do not enter the training area or use equipment.

13.10 Late collection. We contact you and your emergency contacts. A 15-minute grace period applies from the scheduled finish time, after which a supervision charge of AED 50 for each hour or part of an hour applies, because a member of staff must remain on duty. Where late collection repeats, we may decline further enrolment. Where a Participant remains uncollected and we cannot reach anyone within a reasonable period, we contact the relevant authorities in line with UAE child protection requirements.

14. Conduct and gym rules

14.1 Participants and everyone accompanying them follow Aerial's rules and the instructions of Aerial staff.

14.2 Your responsibility for others. Please explain these Terms and the rules below to the Participant and to everyone who accompanies them — siblings, family members, friends, drivers and nannies — and ensure they follow them. You are responsible for their conduct on our premises.

14.3 In the gym.

  • Follow the coach's instructions at all times.

  • Apparatus is used only with a coach present and with permission. Unsupervised use is

where most avoidable injuries happen.

  • Report damaged or unsafe equipment to a coach immediately.

  • No food, drink or chewing gum in the training area. Bring a named water bottle.

14.4 What to wear.

  • Girls: leotard, optionally with a close-fitting T-shirt, shorts or leggings over it. No skirts or

frills.

  • Boys: close-fitting T-shirt and sports shorts.

  • No socks on mats or apparatus — bare feet grip, socks slip.

  • No buttons, zips, buckles or loose drawstrings.

  • All jewellery removed before class. We are unable to store jewellery and are not

responsible for items left behind.

  • Hair tied back off the face. No hard clips or beads. Nails short.

  • Clothing worn for religious reasons should be close-fitting and must not interfere with

safety. Speak to us and we will find a solution.

  • Club uniform is worn when representing Aerial at events and competitions.

14.5 The training area and the waiting area. The training area is a working space with apparatus in motion and coaches spotting, so parents and spectators remain in the designated waiting area. This is not about keeping you away — see clause 7.10 for open training and clause 15.2 for coach meetings.

14.6 Please don't approach a coach mid-session. A coach spotting a child cannot safely divide their attention. Use the request form in clause 15.2 and we will arrange a proper conversation.

14.7 Removal. Aerial may remove a Participant from a programme where they are bullying, endangering themselves or others, or persistently disrupting sessions. Physical or verbal abuse directed at staff, participants, families or members of the public results in immediate removal from the premises and termination of enrolment. This applies equally to accompanying adults. In each case clause 9.1 applies and no refund is due.

14.8 Drugs and unauthorized medicines are prohibited on Aerial premises and at Aerial activities.

15. Communication, feedback and complaints

15.1 One route for requests. All requests — refunds, freezes, feedback, suggestions, complaints and coach meetings — go through our official request form, published across all Aerial channels: our Linktree, our social media accounts, and through our administrators. We do not process requests sent by WhatsApp, because messages there cannot be tracked, assigned or evidenced. The form logs your request with a date so it cannot be lost.

15.2 Coach meetings. A meeting with your child's coach is booked through the form and scheduled within 5 to 10 working days.

15.3 Complaints. We acknowledge receipt within 2 working days and give a substantive response within 10 working days. Where you are not satisfied, the matter is escalated to the

Managing Director.

15.4 Absence notifications also go through the form or the administration, before 11:00 AM (clause 10.1).

15.5 Operational messages. Booking confirmations, invoices, schedule changes and closure notices are sent by email and may also be sent by WhatsApp. Clause 15.1 governs requests you send to us; it does not restrict notices we send to you.

16. Photography and recording

16.1 Recording other people is restricted by UAE law. Photographing or filming another person without their consent, and publishing such material, is an offence under UAE Federal Decree-Law No. 34 of 2021 on Combating Rumours and Cybercrimes (Article 44). Our training areas and waiting areas contain other people's children, coaches and staff.

16.2 Accordingly, please do not photograph, film, live-stream or record at Aerial venues — on phones, cameras, smart watches or any other device — in the training area or the waiting area. Aerial is required to enforce this on its premises, and does so for the protection of every family, including yours.

16.3 If it happens. Anyone recording will be asked to stop and to delete the material. Refusal or repeated breach results in removal from the premises and may end the enrolment under clause 14.7. Where material containing other children has been shared or published, we will require its removal. Any liability arising from such material rests with the person who created or published it, under the law referred to in clause 16.1.

16.4 When you can take photographs. At our open training session each season, and at showcases and end-of-season events, you may photograph your own child. Please do not publish images in which other children are identifiable without their parents' agreement.

16.5 If you would like footage of your child. Ask us through the request form (clause 15.1). Where our staff have suitable material, we will share it with you.

16.6 Our own recording. Aerial staff record training for coaching, technique review, assessment, safety and safeguarding. This material is held on Aerial systems, is not shared with third parties, and is used for promotion only where you have given the separate consent in clause 16.7.

16.7 Marketing consent — separate and optional. Consent for Aerial to use images of a Participant in its website, social media, printed materials and advertising is given separately from acceptance of these Terms, is entirely optional, and may be withdrawn at any time through the request form. Withdrawing or withholding it changes nothing else about your enrollment.

16.8 On withdrawal we stop using the image in new material and remove it from material under our control within a reasonable period. We cannot recall material already printed or distributed, or content republished by others. Where consent has not been given, we take reasonable care to keep the Participant out of promotional content, though we cannot guarantee exclusion from wide shots at public competitions.

16.9 Competitions and public events are photographed by families, spectators, venue operators, organisers and sometimes media. Aerial does not control and is not responsible for images captured or published by third parties at such events.

16.10 Names. We do not publish a Participant's full name with their image without your specific consent. First name and age group may appear in competition results and achievement posts unless you tell us otherwise.

16.11 Aerial's programmes, materials, methodology and recordings are not to be used for commercial purposes or reproduced for the benefit of another provider.

17. Risks and liability

17.1 What we do, and what remains. Section 7 sets out the standards we hold to — group sizes, coach vetting, first aid presence, daily equipment checks, manufacturer-specified apparatus setup, incident reporting and insurance. Those measures reduce risk substantially. They do not remove it. Gymnastics involves height, rotation, inversion, impact and apparatus, and injuries occur in well-run gyms everywhere.

17.2 The risks you accept. Falls from apparatus and from height; collisions with apparatus, the floor or other participants; injury from the use, misuse or failure of equipment; strains, sprains, dislocations, fractures and head injuries; aggravation of an existing condition; and, in rare cases, serious injury, permanent disability or death.

17.3 Where risk arises. From the activity itself; from the Participant's own actions, attempts or errors; from other participants; from equipment; from the condition of a venue; or from circumstances beyond our control.

17.4 Voluntary participation. Participation is voluntary. You decide whether an activity is appropriate for the Participant and may withdraw them at any time.

17.5 How liability is allocated. The parties agree that responsibility is allocated as set out in Section 6. Aerial answers for what it controls; you answer for what you control. This allocation is the basis on which fees have been set.

17.6 Limitation. To the maximum extent permitted by the laws of the United Arab Emirates, Aerial and its owners, directors, employees, coaches, volunteers and representatives are not liable for injury, illness, loss, damage or death arising from participation, except where it results from Aerial's gross negligence or wilful misconduct. For contractual claims, Aerial's

aggregate liability is limited to the total fees paid by you in respect of the Participant in the 12 months preceding the event.

17.7 Specific exclusions. Without limiting clause 17.6, Aerial is not liable for:

  • (a) injury resulting from the Participant's own act, error, misjudgment or failure to follow a coach's instruction;

  • (b) injury resulting from a failure to follow the rules in Section 14;

  • (c) injury or consequences arising from medical information not disclosed, or disclosed inaccurately or late;

  • (d) anything occurring outside the supervision window in clause 6.2;

  • (e) anything occurring after a Participant leaves the premises under clause 13.6;

  • (f) the acts or omissions of a third-party venue, its staff or its security;

  • (g) the acts or omissions of other participants, parents, spectators or members of the public;

  • (h) images or recordings captured or published by third parties;

  • (i) loss of or damage to personal property or valuables.

17.8 Your rights are not removed. UAE law does not permit a business to exclude every liability by agreement, and Aerial does not attempt to. Clauses 17.6 and 17.7 set the limit of our liability within what UAE law allows and do not operate beyond it. Nothing in these Terms removes a right you hold under UAE law or prevents you from bringing a claim before the courts.

17.9 Notification of claims. Please report any incident to a member of staff before leaving the premises, and any claim in writing within 30 days. Early notice allows us to investigate while the facts are fresh; it does not affect any right you hold by law.

18. Property

18.1 Aerial is not responsible for loss of or damage to personal property or valuables belonging to a Participant or anyone accompanying them.

18.2 Please do not bring valuables, and please label everything. Unclaimed lost property is held for 30 days and then donated.

18.3 You are responsible for the cost of repairing damage caused by you or the Participant to a venue, its equipment or its fittings.

19. Indemnity

You will indemnify Aerial against costs, losses and claims arising from: an act or omission of the Participant; a breach of these Terms by you, the Participant or anyone accompanying them; damage caused to a venue or a third party's property; and a failure to disclose medical information required under clause 12.2.

20. Personal data

20.1 Aerial processes personal data in accordance with UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data.

20.2 We deliberately collect and process children's personal data, including medical information, on the basis of parental consent given at registration, in order to coach safely, manage enrolment and billing, and reach you in an emergency.

20.3 Data is shared only with those who need it: our coaching and administration team, our registration and class management systems, our accounting provider, our payment providers, our insurers, and where required the operator of a venue at which a class is held.

20.4 Marketing consent is separate and optional (clause 16.7). Refusing it does not affect enrollment.

20.5 Full details are in the Aerial Privacy Notice at https://www.aerial- gymnastics.com/privacy-policy. You may request access, correction or deletion through the request form, subject to our obligation to retain certain records for legal, tax, insurance and safeguarding purposes.

21. General

21.1 Written terms prevail over anything said verbally. Where something said by a coach or member of staff differs from these written Terms, these Terms prevail. No employee can vary them verbally; any variation is effective only in writing from Aerial management.

21.2 Changes. The current version, with version number and effective date, is published at https://www.aerial-gymnastics.com/terms-conditions. Where a change materially affects fees, refunds or make-up entitlements, we notify enrolled families in writing at least 14 days before it takes effect, and it does not apply to a package already paid for.

21.3 Entire agreement. These Terms supersede all previous terms, guidelines, waivers, rules sheets, refund policies and understandings, written or verbal.

21.4 Severability. If any provision is held invalid or unenforceable, the rest continues in full force and the affected provision applies to the fullest extent permitted by law.

21.5 No waiver. A failure to enforce a provision on one occasion is not a waiver of it.

21.6 Assignment. You may not transfer your rights under this agreement. Aerial may transfer its rights and obligations to another entity within the same ownership on written notice.

21.7 Language. These Terms are issued in English and Arabic. Both versions are equally authentic; in the event of any discrepancy, the Arabic version prevails.

21.8 Governing law. The federal laws of the United Arab Emirates and the laws of the Emirate of Abu Dhabi.

21.9 Jurisdiction. Any dispute is subject to the exclusive jurisdiction of the courts of Abu Dhabi. Before commencing proceedings, both parties will attempt in good faith to resolve the matter through the complaints process in clause 15.3.

22. Your declarations

By ticking the acceptance box, you confirm:

1. I am the parent or legal guardian of the Participant, or an adult registering myself, and I am accepting from my own email address or mobile number. 2. The information given at registration, including medical and emergency contact information, is true and complete, and I will keep it up to date. 3. The Participant is physically able to take part, and I know of no condition making participation unsafe. 4. The Participant holds valid health insurance cover. 5. I have read Section 6 and I understand who is responsible for my child at each moment, and that outside Aerial's supervision window the Participant is my responsibility. 6. I have read Section 17 and I accept the inherent risks of gymnastics, including the risk of serious injury. 7. I authorise Aerial to give first aid and to arrange emergency medical treatment and transport if needed, and I accept the cost. 8. I have read Section 16 and I understand that recording at Aerial venues is restricted by

  • UAE law and is not permitted.

9. I will explain the rules to the Participant and to everyone who accompanies them, and I am responsible for their conduct on our premises. 10. I understand that fees are non-refundable except in the situations set out in Section 9. 11. I understand that absence must be notified before 11:00 AM on the day of the class for a make-up to be available. 12. I understand that payment handed directly to a coach is not accepted. 13. I understand that requests and complaints go through the official request form, not

  • WhatsApp.

14. I understand that where a member of staff says something different from this document, this document prevails. 15. I agree to Aerial processing personal data, including the Participant's medical information, as set out in Section 20.

Separate and optional — marketing consent (clause 16.7):

☐ I consent to Aerial using photographs and video of the Participant in its website, social media channels, printed materials and advertising.

☐ I additionally consent to the Participant's first name and age group appearing with competition results and achievement posts.

Independent arrival and departure (clause 13.6) requires a separate written authorisation and is not given here.
